Is CBD and Vijaya Extract Legal in India? What Buyers Actually Need to Know

Cover: Is it legal in India? - an Rx seal reading prescription first

This is the question that stops most Indian buyers, and the internet answers it badly — with either confident oversimplification or enough hedging to be useless. Here is a clear account of how the category actually works, and where the genuine grey areas are.

The short version

Vijaya leaf extract products are supplied in India within the Ayurvedic medicine framework. They are manufactured under Ayush approval in licensed facilities, and they are dispatched against a prescription from a registered practitioner. That prescription step is not decoration — it is the mechanism that makes lawful supply work. A site selling you a cannabis-derived product with nothing more than an age tickbox has skipped it.

Why the leaf matters

The single most important technical point in this whole category is which part of the plant a product comes from. Indian narcotics law treats the parts of the cannabis plant differently. The flowering tops and the resin sit in one place; the leaves sit in another. Vijaya leaf extract — the basis of Cannexia's products and of the legitimate Indian category generally — is made from the leaves.

This is why you will see Indian brands specify "Vijaya (Cannabis sativa L.) leaf extract" rather than just "cannabis extract." It is not marketing precision. It is the whole basis of the product's position.

Why a prescription is required

Cannabis-containing Ayurvedic preparations fall under Schedule E(1), the schedule covering substances to be taken under medical supervision. That is why product pages in this category carry "to be taken only under medical supervision," and why any properly operating brand puts a practitioner between you and the product.

In practice, for a customer, this should mean a doctor speaks to you before your order ships. With Cannexia that consultation is free, included with every order, and a registered Ayurvedic doctor issues the prescription before anything is dispatched. You do not arrange it, upload anything, or pay extra.

What this means for you as a buyer

You are not doing anything irregular by ordering from a licensed brand that runs a proper prescription process. What you should check is that the brand actually runs one. The checks are simple:

  • Does the product say leaf extract?
  • Is there an actual consultation with a practitioner before dispatch, or just a checkbox?
  • Does the brand state Ayush approval and GMP manufacturing, and will it show you a lab report for your batch?
  • Does the copy avoid promising to cure named diseases? Brands making disease claims are not being carefully advised.

We wrote the longer version of this in how to tell if an Indian CBD brand is genuine.

The questions that always come next

"Will I get in trouble for ordering online?"

Ordering from a licensed brand that issues a prescription before dispatch is the intended route. The risk people are actually thinking about comes from unlicensed sellers — marketplace listings with no licence, no practitioner and no batch traceability. That is where the problem lies, not with a prescribed Ayurvedic preparation.

"Can I travel with it inside India?"

Keep the product in its original labelled packaging and carry your prescription with it. The prescription is the document that explains what you are carrying and why. Do not decant it into an unlabelled bottle — that removes the only evidence of what it is.

"Can I take it out of India, or bring it in?"

Don't, unless you have specifically checked. Cannabis-derived products are regulated very differently country to country, and a product that is lawfully prescribed to you in India may be prohibited at your destination. An Indian prescription carries no weight at a foreign border. This one genuinely catches people out.

"Will it show up on a drug test?"

Standard drug screening tests for THC. Products containing THC can therefore register on one, and several Cannexia products are THC-rich. If you are subject to workplace or sports testing, raise it during your free consultation before you order. Do not assume a "wellness" framing protects you — the test does not care about framing.

"Is there an age limit?"

Adults only. The single exception in our range is Happy Paws Drop, which is a pet product and not for humans at all.

An honest note on what this article is

This is a plain-language explanation of how a licensed Indian Vijaya brand operates, written for buyers. It is not legal advice, and it does not cover every situation — particularly anything involving travel across borders, employment testing, or an existing medical condition. Those deserve a proper answer from someone qualified, and the free doctor consultation with your order is a good place to start.
